By using aiStudyBuddy.academy ("Service"), you agree to these terms. If you are creating accounts for children, you represent that you are their parent or legal guardian and have authority to consent on their behalf.
Children's Privacy (COPPA Compliance)
Parental Consent Required
- Children Under 13: Requires verifiable parental consent for data collection
- Children 13-17: Parent must create and manage all accounts
By creating a student account, you consent to our collection and use of your child's information as described here and in our Privacy Policy.
Information We Collect from Children
With your consent, we collect:
- Student name, grade level, and age
- Tutoring session conversation logs
- Assessment responses and performance data
- Uploaded educational materials
- Technical information (device type, IP address for security)
How We Use Student Data
Student data is used only for:
- Providing AI tutoring sessions
- Generating progress reports for parents
- Improving service quality (aggregated, de-identified data only)
- Safety monitoring and fraud prevention
We do NOT:
- Sell, rent, or monetize student data or parent account data to any third parties
- Sell, rent, or monetize any data collected from account holders or students
- Use student data for advertising or marketing purposes
- Share student data except with essential service providers (Google Gemini, Supabase, Stripe, DigitalOcean)
- Retain data longer than necessary for educational purposes
- Use your data for any purpose other than providing and improving our tutoring service
Your Parental Rights
You have the right to:
- Review your child's data anytime
- Request deletion of your child's data
- Withdraw consent at any time
- Access and download all student records

AI Tutoring: Critical Disclaimers
What AI Tutoring Is
Our Service uses artificial intelligence (Google Gemini) to provide interactive tutoring for K-12 students. The AI adapts instruction to student age and learning pace.
Important Limitations
YOU ACKNOWLEDGE THAT:

AI is Not a Human Teacher - The AI cannot replicate human judgment, emotional intelligence, or contextual understanding

No Accuracy Guarantee - The AI may occasionally:
- Provide incorrect information
- Misinterpret student responses
- Generate nonsensical content due to logical fallacies introduced during LLM creation (also known as Confabulation)
- Fail to detect misunderstandings

No Educational Guarantees - Use does not guarantee:
- Improved grades or test scores
- Subject mastery
- College admission or scholarships

Supplement Only - This Service supplements, does not replace:
- Classroom instruction
- Human tutors or teachers
- Parental supervision
- Special education services for students with IEPs

Supervision Required - Parents must:
- Monitor younger children's sessions
- Review session transcripts regularly
- Report concerning AI responses immediately
- Seek professional help for serious learning difficulties
Data Security
We protect your data with:
- Encryption (TLS/SSL and AES-256)
- Secure authentication
- Regular security audits
- SOC 2 compliant data centers
- Written Information Security Program
Third-Party Services:
- Supabase - Database and authentication
- Google Gemini - AI tutoring engine
- Stripe - Payment processing

All service providers are contractually required to protect student data and comply with COPPA.
Data Breach Notification: We will notify you within 72 hours of any breach affecting your data.
Payment and Refunds
Pricing:
- Free Trial: 2 sessions (no credit card)
- Single Session: $4.99
- 10-Pack: $39.99 ($3.99/session)
- 25-Pack: $89.99 ($3.60/session)
Refund Policy:
- Unused credits refundable within 30 days of purchase
- Used sessions are non-refundable

Prohibited Uses
You may NOT:
- Upload copyrighted materials without permission
- Submit inappropriate, illegal, or harmful content
- Use the Service to cheat on graded assignments
- Share account credentials with unauthorized users
- Attempt to hack, reverse engineer, or abuse the system
- Create accounts with false information
Violations may result in immediate account termination without refund.
Intellectual Property
The Service and all underlying technology is owned by aiStudyBuddy.academy. You receive only a limited license to use the Service for personal, non-commercial educational purposes.
You retain ownership of:
- Student data and responses
- Uploaded materials (subject to third-party rights)
- Assessment results and progress reports
Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES.
We make NO warranties regarding:
- Service availability, security, or reliability
- Accuracy of AI-generated content
- Educational outcomes or results
- Fitness for your specific needs
WE DO NOT PROVIDE professional educational, psychological, medical, or legal advice.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
We are NOT liable for:
- Educational setbacks or academic failures
- Indirect, incidental, or consequential damages
- Loss of data, profits, or goodwill
- Emotional distress
Maximum liability is the lesser of:
- Amount you paid in the last 3 months, OR
- $100
Account Termination
You may terminate anytime by:
- Using our contact form at https://aistudybuddy.academy/ (click any "Contact us" button with subject "Account Deletion Request")
- Download your data first using the "Download Your Data" button in your Parent Dashboard
Upon Account Deletion:
- Access to Service terminated immediately
- Session credits forfeited (unless refund requested within 30 days)
- All student data (sessions, files, progress reports) deleted from production systems within 30 days
- Backup systems purged within 90 days
- You will receive confirmation email when deletion is complete
Legal Retention Exceptions:
- Financial records retained 7 years per IRS requirements (transaction amounts only, no educational data)
- Aggregated, anonymized analytics retained indefinitely (contains no personally identifiable information)
Fraud Prevention After Account Deletion:
To prevent abuse of free trial credits, we retain minimal anonymized data for up to 2 years after account deletion:
- One-way cryptographic hash of your email (SHA-256 - cannot be reversed to identify you)
- Credit card fingerprint (last 4 digits + card type + issuer, NOT full card number)
This data is:
- ✅ Truly anonymized (cannot identify you personally)
- ✅ Stored separately from all other account data
- ✅ Used solely to prevent free trial abuse
- ✅ Automatically deleted after 2 years
- ✅ Legitimate interest under GDPR Article 6(1)(f) and US fraud prevention laws
Impact on Future Signups:
If you create a new account with the same email/card after deletion:
- ❌ You will not receive another free trial (free trials are one-per-user)
- ✓ You can still use the service by purchasing credits
- ✓ All your rights (data export, deletion, etc.) remain unchanged
This policy balances fraud prevention with your privacy rights and is standard practice in the industry.
We may terminate your account if you:
- Violate this Agreement
- Engage in fraudulent activity
- Fail to pay fees owed
Dispute Resolution
Before filing a claim, you must use our contact form at https://aistudybuddy.academy/ (click any "Contact us" button with subject "Legal Dispute") to resolve informally.
Binding Arbitration:
- All disputes resolved through binding arbitration (American Arbitration Association)
- No class actions - individual arbitration only
- Arbitrator's decision is final and binding
Exception: Small claims court (under $10,000) or injunctive relief for IP violations.
Governing Law: Delaware law applies. Venue is Kent/Delaware.
Modifications to This Agreement
We may modify this Agreement at any time. When we do:
- You'll receive email notification
- You'll see an announcement on your dashboard
- You'll have a grace period (typically 30 days) to review and accept
Continued use after the grace period = acceptance of new terms.
If you reject the changes, you must stop using the Service and may request account deletion and refund.
Your Data Rights
For All Users:
- Access your account data anytime
- Download your data
- Request account deletion
- Opt out of marketing emails
For Parents of Children:
- Review all child data collected
- Request child data deletion at any time
- Withdraw consent for data collection
- Receive detailed privacy information
